The following pages 'Terms and Conditions', contain important information about the rights and responsibilities of both CloudBag and CloudBag customers.

In these terms and conditions, the terms 'seller', 'we' and 'us' refer to  ILLIQUID ENTERPRISE PTY LTD, trading as CloudBag (ABN 68 142 032 728): and 'you' and ‘your’ refer to you the customer.

CloudBag owns and operates this website. By using or accessing this website you acknowledge that you have read, understood and agreed to be bound by these terms and conditions. If you do not agree to comply with the following regulations, please refrain from purchasing products from CloudBag. CloudBag will take appropriate and considered action to uphold these terms and conditions.

CloudBag may revise the Terms and Conditions at any time, in its absolute discretion by posting revised terms and these revisions will be effective immediately.

 

Ownership of Website and Content

CloudBag owns the website, and unless otherwise indicated, owns or is licensed to use all content and material appearing on the website. The material on this website is protected by copyright under the laws of Australia and may not be used without written permission by CloudBag.

 

Security

CloudBag cannot guarantee any data or program available for download on this website is free of viruses or other spyware and you agree that you assume the risk of any damage to your computer as a result of using this website of which CloudBag is not liable for.

 

Liability

CloudBag provides this website and its contents on an as is basis and makes no representation as to the accuracy, currency or reliability of the information contained on this website. CloudBag will not be liable in contract or otherwise to you for any direct, special, indirect or consequential loss or damage (including loss of profits or data) arising out of or in connection with this website.

 

Privacy

We are committed to providing all of our customers with privacy. Refer to CloudBag Privacy Policy for further information.

 

Product Purchase

The Agreement

The terms and conditions, together with your order, constitute the entire contract between us and you for the supply of products. By accepting this agreement, you indicate that you will comply with the following regulations and note that the contract cannot be varied unless we agree to alter it in writing or by email.

 

Orders

Online orders are placed with CloudBag via our website. Orders are placed by selecting the "buy now" button and then proceeding to press the "purchase now" button on the checkout page. CloudBag reserves the right to accept or reject an order for any reason including without limitation, unavailability of a product; an error in the price, image or the product description; or an error in your order. Orders are deemed accepted by CloudBag upon receipt of payment.

Upon shipment customers will receive a tracking email with information regarding your delivery and the ability to track your delivery.

 

Product Availability

CloudBag aims to ensure that all products ordered through the CloudBag website are available for delivery. If an item is out of stock or there is a delayed delivery CloudBag will notify you via email.

All orders must be paid in full (apart from Layby) at the time of placing an order. To pay for products, you will. be transferred to an external site operated by Brain Tree, a Paypal Company. Payments made through CloudBag website are Comodo Secure.

 

Payment

Payment Options

CloudBag accepts payment for our goods and services in the following formats:

  • Direct Bank Deposit (please contact CloudBag for further details)
  • Credit Card (visa or Mastercard)
  • Paypal
  • Afterpay
  • Zipmoney

Layby

CloudBag also offer layby as an alternative payment and ordering option for customers.

Layby orders are placed with CloudBag via our website. Orders are placed by selecting the "layby now" button. CloudBag reserves the right to accept or reject a layby order for any reason including without limitation, unavailability of product; an error in the price, image or the product description; or error in your order.

Customers are required to leave a 10% deposit upon placing a layby order. Layby orders are deemed accepted by CloudBag upon receipt of payment for the deposit. If a deposit payment is not made layby orders will be automatically cancelled within 7 calendar days.

Layby payments can be made over the phone or online through CloudBag " Manage your layby system". Customers are not required by law to make regular payments although CloudBag encourages this practice.

All layby payments made online using the 'manage your layby' system require a password. For your privacy and security do not share this password with another individual. CloudBag is not liable for any loss or damage caused if the password is shared.

Laybys placed with CloudBag require finalisation within 12 months from the date of deposit. If the layby is not finalised within 12 months CloudBag has the right to cancel the layby.

If you change your mind or would like to cancel your layby, CloudBag has the right to charge a $25 termination fee. This fee covers administrative and storage costs. a refund is available for any amounts paid minus the termination fee.

 

Website and product variation

CloudBag reserves the right to alter information on the website at any time.

 

Colour Information

CloudBag aims to provide accurate images and colours for our current stock range. Please note that colours and models displayed may differ from the actual stock that you receive due to upgrades, improvements or colour settings on a customers computer.

 

Price Changes

Prices on the website are subject to change at any time due to fluctuations with domestic and international markets. Price changes are subject to the discretion of the appropriate parties, and can change between inquiries and point of sale. Consequently our customer service team will also aim to ensure any prices changes are disclosed.

 

Delivery

Delivery Zone Map

CloudBag offers free delivery* on all of your CloudBags and replacement parts, using our reliable courier partner Direct Freight Express.

All orders placed by midday on a business day will be shipped the same day.

Upon shipment customers will receive a tracking email with information regarding your delivery and the ability to track your delivery at www.directfreight.com.au.

Direct Freight couriers are advised to leave items in a safe place if there is no-one available as a signature is not required. If the courier does not deem the property safe they will leave a card for the arrangement of collection.

Please also note delivery is door to door, couriers are not required to assemble goods.

Shared delivery charges differ for each product, when applicable the cost will be displayed once you confirm  your address details at checkout.

Please also note in the case of customer error and exchange, freight charges at the expense of the customer apply.

 

Incorrect or damaged Order Delivery

If the customer receives an incorrect order (eg. size) at CloudBag fault, CloudBag will aim to correct this mistake immediately at no extra cost to the customer.

If a customers order does not arrive as a complete delivery or is a partial delivery please contact CloudBag to rectify this error.

If a CloudBag purchased is deemed faulty or damaged upon delivery, CloudBag will arrange for a replacement part to be sent to the customer.

*Please note that if a customer paid for installation of their CloudBag, if replacement parts or CloudBag exchanges occur; CloudBag will not be responsible for the cost of rehiring further installation.

 

Refunds and Returns

CloudBag refunds and returns policy is in place to ensure our customers continue to receive the best possible experience with CloudBag.

You can return your purchase for any reason as long as it is in unused, pristine condition. Returns are to be sent back at your own cost to our returns address. Returns will be refunded at full price less initial shipping costs. If damage is detected or parts are missing upon return, those items will be deducted from your refund.

Accessories and Replacement Parts

At CloudBag we have a wide variety of accessories and replacement parts that are compatible with most CloudBags including those made by other manufacturers. However we cannot guarantee that our replacement parts will be compatible so please check the products individual SPECS or our buying guide for further information.

If customers purchase a replacement part that is incompatible or you change your mind, please contact our customer service team. Incorrect items can be returned (at the customers expense for postage/courier cost) for a refund or exchange minus the original order delivery costs. Delivery costs will vary.

Refunds are only granted if the product is in an unused, as new and fit for resale condition. Refunds are not valid for used or damaged goods. Refunds are also only available for three months from the original purchase date and exclude original order delivery costs.

Refunds will be processed 7-14 days after the goods have been received into our warehouse and processed. The method of refund will be the same method that payment was originally received by CloudBag.

If the customer would like to return the CloudBag for a refund or exchange, they will need to organise a return via courier at their expense and a $45 inspection and repacking fee will apply. If the CloudBag or parts are not 'as new' or fit resale, have been opened, used or damaged; customers will also be liable for the cost of replacing the parts and the refund offered will reflect this.

Refunds are also only available three months from the original purchase date, and will exclude delivery costs.

Warranty Policy

At CloudBag our products are made from the highest quality and standards and therefore we maintain some of the highest warranties in the industry. Please check individual product SPECS for individual product warranty details.

Warranty periods commence from the date of purchase.

Warranty inclusions:

  • Manufacturing issues
  • Damaged parts upon receipt of goods


Warranty Exclusions:

It is essential that customers regularly check their CloudBags and follow the maintenance tips to ensure the longevity of their CloudBag. Warranties are non- transferable and apply to the original purchaser only.

  • Weather Damage: Damage caused to your CloudBag as a result of weather events such as rain, wind etc.. are not covered under CloudBag warranty. If you CloudBag is damaged by a weather event, please contact your home insurance provider.
  • Personal Injury: CloudBag warranty does not include cover for personal injury or losses due to improper assembly, maintenance or use of your CloudBag.

CloudBag warranty does not apply to any damage caused by a third party assembly service.

What to do you if you have a warranty issue?

If a warranty issue does arise, please contact our customer service department via email sales@cloudbag.com.au to discuss the issue further.

In the event that CloudBag does not feel the product is covered under warranty and a second opinion is required, the customer will be required to send the product to us at their own cost including inspection and delivery for a full appraisal.

All products on this website (unless otherwise specified) are designed and intended for domestic use only.  Manufacturers warranty does not cover any product if it is used in a commercial or public environment.

Gift Vouchers

These conditions apply to CloudBag Gift Voucher. Purchasing and using a gift voucher means you accept the terms and conditions of this agreement.

Gift Vouchers cannot be redeemed for cash and cannot be used for cash equivalent transactions. They cannot be reloaded, returned for a refund, have their balances consolidated to a new gift voucher or be replaced after expiry.

All CloudBag Gift Vouchers have a six month expiry. After the gift voucher has expired, it is no longer valid and any discounts or transactions using the voucher will be declined.

All gift vouchers must be kept secure. If your gift voucher is lost or stolen or you suspect unauthorised transactions using the voucher, please email CloudBag on sales@cloudbag.com.au.

CloudBag has the right to cancel any gift voucher at any time without notice. If so, CloudBag may either provide a refund or a replacement gift voucher or equivalent value unless we reasonably suspect fraud in relation to a gift voucher. CloudBag may also, in its complete discretion refuse to sell gift vouchers to any person at any time for any reason.

CloudBag is not liable for any delay in performing any of its obligations under these terms and conditions, if such a delay is caused by circumstances beyond the reasonable control of CloudBag. If this type of delay does occur CloudBag shall be entitled to a reasonable extension of time for the performance of such obligations.

No other reproduction or use of www.cloudbag.com.au copyright material is allowed without CloudBag written approval.

The directors, officers, staff and agents of CloudBag are responsible for maintaining this website and that the information contained within this website is correct, however you use this website at your own risk.

You accept all risks and responsibility for loss, damage, costs and other consequences resulting from using this website and any websites linked to it. You are also responsible for accessing the relevance and accuracy of any information or material available, from this website or any websites linked to it.

Further we disclaim all responsibility to the maximum extent possible under applicable laws:

When submitting images, customers are willingly entering into an agreement that CloudBag are permitted to republish these images on their social media and website platforms.  Past winners are not eligible to win.
